Somaliland: In Failed Appeal UK Court Orders the Union of the Comoros to Pay £110,000 to UAE based Union Marine

Somalilandsun – interesting ruling in case involving the Government of the Union of the Comoros, member of the Africa Union, and the UAE based Union Marine.

The Respondent, Union Marine were represented by our client, Zaiwalla & Co Solicitors, an international City Law firm based in London with a special Middle East desk.

What is particularly interesting about this case, is that the Judge in this instance not only ordered the Government of the Comoros to comply with previous court orders but he also ordered them to pay additional costs and dismissed the entire appeal outright on the grounds it had no chance of success.

English Court orders the Union of the Comoros to pay £110,000 to Union Marine after failed appeal

In the latest development from the UK High Court proceedings between the Government of the Union of Comoros and their flag administrator Union Marine of the UAE, Mr Justice Males of the English Commercial Court has ordered the Government to comply with an outstanding order of the court to pay £70,000 costs to Union Marine, its current challenge against the Arbitration Award of Mr Bruce Harris will stand dismissed. The earlier order for payment was made against the Government by Mr Justice Leggatt, at the hearing of Union Marine’s application to appointment Mr Harris as the Arbitrator in October 2013.

Mr Justice Males also dismissed the Government’s appeal against the Arbitration Award as having no prospects of success, and ordered Comoros to pay a further £40,000 in costs to Union Marine.

Union Marine is represented by Zaiwalla & Co Solicitors of London.

Commenting on the development Mr Kartik Mittal, Solicitor at Zaiwalla & Co Solicitors said: “Today was a resounding success. Not only did the judge dismiss the appeal against the original arbitration, but the Government of Comoros has been forced to cover Union Marines costs.”
